PAYBAYGO - PARKING SPACE CANCELLATION POLICY
1. Scope and Applicability
- This Cancellation Policy governs all cancellations initiated by Users in relation to parking spaces booked, reserved, or otherwise scheduled through the PayBayGO Platform.
- This Policy forms an integral part of the Master Terms & Conditions and shall apply uniformly across all parking locations, save where the applicable Operator has expressly published specific cancellation parameters that supersede or supplement these terms.
- The cancellation framework applies to:
- Reservations made at parking spaces owned or controlled by Operators who partner with PayBayGO;
- Reservations offered directly by Operators who have granted PayBayGO the right to list, schedule, or accept bookings on their behalf;
- Any blended or hybrid booking models where both automated and operator-confirmed workflows exist.
- Nothing in this Policy alters PayBayGO’s status as a digital PayBayGO does not own, manage, supervise, or control the physical parking locations, and cancellation rights are ultimately governed by Operator-specific rules, where applicable.
2. User-Initiated Cancellations
- Users may cancel a parking reservation through the Platform interface (mobile application or website) using the cancellation mechanism made available in their booking details.
- For cancellations made at least one hour before the scheduled parking start time, Users shall receive a full refund of the booking amount, credited either to the User’s PayBayGO Wallet or the original payment method, depending on the Platform’s then-prevailing refund
- For cancellations made within one hour of the scheduled parking start time, Users will be eligible only for a partial refund, determined strictly in accordance with the respective Operator’s refund rules, pricing model, and cancellation parameters.
- Where an Operator imposes location-specific cancellation deductions, service charges, or minimum retention fees, such Operator-imposed rules will automatically govern the refund
- If a User fails to initiate cancellation before the scheduled start time and does not utilize the space, the reservation shall be deemed a “no-show,” and the Operator may impose a zero- refund outcome unless explicitly stated otherwise.
- PayBayGO bears no liability for cancellations not successfully completed due to the User’s technical, network, or device limitations.
3. Operator-Initiated Cancellations
- An Operator may cancel a reservation due to operational issues, maintenance requirements, temporary unavailability, compliance directives, or other legitimate reasons.
- In such cases, PayBayGO will issue a full refund of the booking amount (exclusive of non-refundable Operator-specified fees, if any), irrespective of the timing of cancellation.
- PayBayGO may, but is not obligated to, facilitate an alternative parking Any such facilitation is solely discretionary and subject to availability.
- PayBayGO is not liable for any consequential, incidental, or indirect damages arising from Operator-initiated cancellations, including but not limited to lost time, inconvenience, business interruption, or any perceived loss of opportunity.
4. Refund Method, Processing Timeline, and Wallet Integration
- Refunds will be processed either:
- Back to the User’s PayBayGO Wallet, or
- To the original payment instrument, where permitted by the Payment Gateway and internal compliance frameworks.
- Refund timelines may vary based on Gateway settlement cycles, banking institution processes, and Operator reconciliation windows.
- PayBayGO does not guarantee instant refunds unless explicitly communicated at the time of booking.
- Refunds credited to the PayBayGO Wallet may be used exclusively within the Platform, in accordance with the Wallet Terms contained in the Payment Terms Section of the Master T&C.
- Wallet-based refunds do not expire, but cannot be withdrawn externally unless mandated by Applicable Law.
5. Late Arrival, Early Departure, and Partial-Use Scenarios
- A User arriving late for a reservation shall not be entitled to any refund for the unused portion of the reserved period.
- If the User chooses to exit the parking space earlier than scheduled, no proportional or partial refund shall be provided.
- Where the User exceeds the permitted booking window, overage charges or additional parking fees will be applied according to the Operator’s pricing model, consistent with Section 4 (Uses of the Platform) and the Payment Terms incorporated within this Master T&C.
6. Operator Rules and Supremacy Clause
- Each Operator may impose specific cancellation windows, refund deductions, minimum non-refundable components, or administrative charges.
- Where an Operator’s rules differ from this Policy, the Operator’s rules shall prevail for the purpose of calculating the User’s refund, fee deduction, or eligibility.
- PayBayGO will display Operator-specific cancellation conditions wherever feasible, but the absence of such display does not negate their applicability.
7. Non-Refundable Fees
- Certain components of a reservation may be designated as non-refundable, including:
- Operator-defined administrative charges;
- Platform convenience fees;
- Any ancillary service add-ons marked as non-refundable during
- Where such charges exist, refund calculations will exclude these amounts regardless of cancellation timing.
8. Technical Failures, Connectivity Issues, and Exceptions
- PayBayGO is not responsible for cancellations that fail due to:
- User device malfunction;
- Internet connectivity failures;
- Third-party telecom disruptions;
- Gateway downtime;
- Operator system synchronization
- In exceptional cases where a cancellation fails solely due to a confirmed Platform malfunction, PayBayGO may, subject to internal validation, process a refund that would have been available had the cancellation succeeded.
9. Abuse of Cancellation Mechanisms
- PayBayGO reserves the right to monitor cancellation patterns to detect misuse, including repeated speculative bookings or cancellations intended to game Operator availability.
- In cases of abuse, PayBayGO may impose temporary restrictions, penalties, or account suspension in accordance with Section 6 (Prohibited Activities) and Section 10 (Indemnification) of the Master T&C.
- PayBayGO may deny future refund eligibility for Users who engage in fraudulent cancellation behaviour.
10. Finality of Refund Determination
- All refund outcomes are subject to Operator confirmation and PayBayGO’s internal validation processes.
- Refund decisions once communicated shall be treated as final, save where new evidence demonstrates Platform error or Operator misrepresentation.
- Users may approach PayBayGO Support for escalation, but PayBayGO is not obligated to overturn Operator-grounded determinations.
11. No Liability Clause
- PayBayGO bears no liability for losses arising from cancellations, including inconvenience, inability to secure alternative parking, delay, economic loss, or any indirect/consequential damages.
- PayBayGO’s only obligation in cases qualifying for refund is to return the eligible amount as per this Policy.
- Nothing in this clause affects statutory rights that cannot be waived under Indian
12. Amendments to this Cancellation Policy
- PayBayGO may amend, modify, or revise this Cancellation Policy at any
- Changes shall take effect upon publication within the Platform or Master T&C.
- Continued use of PayBayGO after amendments constitutes acceptance of the revised Cancellation Policy.
